• Nike on Monday filed a patent infringement lawsuit against Lululemon over footwear. 
• Lululemon launched its footwear line in 2022. It exceeded expectations.
• The case is the latest in a string of lawsuits filed by Nike against footwear competitors. 

Nike is suing Lululemon, again. This time the sportswear giant is suing over the Canadian company’s footwear, which Nike claims infringes on multiple patents. 

The lawsuit is the latest sign of Nike’s growing confidence in its ability to protect the intellectual property of its footwear and another salvo in the battle against Lululemon, whose diehard consumer base poses a direct threat to Nike. 

The shoes in question are the Chargefeel Mid, Chargefeel Low, Blissfeel, and Strongfeel, which Nike broadly says violate three patents related to textiles, including knitted elements and webbed areas, and one specific to how the shoe’s materials expand when being used during physical activity.

Nike is seeking unspecified damages in the case. The suit was filed in the Southern District Court of New York. 

“Nike’s claims are unjustified, and we look forward to proving our case in court,” a Luluelemon spokesperson said in a statement to Insider. 

Lululemon, long known for its workout apparel, made its first foray into footwear in March 2022. The footwear launch exceeded expectations and is expected to continue ramping up as Lululemon continues investing in footwear development, notably at a new Portland office just miles from Nike’s global headquarters. 

Nike also took legal action against Lululemon in January 2022, when the sportswear giant sued Lululemon over its Mirror home-fitness machine, alleging Lululemon infringed on Nike patents that allow users to compete with each other, track their performance, and pinpoint specific fitness goals.

Lululemon purchased Mirror for $500 million in 2020 when Americans were frequently exercising at home at the height of the pandemic. 

Nike has sued a number of competitors over footwear designs in recent months, including Bape, Cool Kiy, and Warren Lotas. 

A long-running lawsuit between Nike and Adidas over knitted-shoe technology settled last year. 

HBO

• Angry fans are review-bombing the latest episode of HBO’s “The Last of Us.”
• Some user reviews on Metacritic included homophobic comments.
• The episode features a same-sex relationship that expands on a character’s backstory from the game.

HBO’s latest episode of “The Last of Us,” its new video-game adaptation, aired Sunday to widespread praise and impressive ratings.

But the episode, titled “Long, Long Time,” is seemingly getting review-bombed by angry, homophobic fans of the game.

On the review aggregator Metacritic, the episode has a user rating of 4.2 (out of 10) as of Tuesday morning — much lower than the first and second episode’s scores of 8.8 and 8.9, respectively.

In the past, review-bombing — or when people deliberately give a show or movie a low rating to decrease its score on sites like Metacritic and Rotten Tomatoes — has typically occurred for racist, sexist, or homophobic reasons.

Looking through the user reviews, it’s clear that some of the game’s fans didn’t like the episode’s central love story between Bill, played by Nick Offerman, and Frank, played by Murray Bartlett.

In the game, it’s evident that Bill is gay and had a relationship with Frank, who never appears on-screen.

The HBO series takes their relationship in a different direction: In a flashback, Frank comes across Bill’s house after being the lone survivor of a group traveling to the Boston quarantine zone. From there, the episode recounts their romance over the course of nearly two decades until it catches up to the present.

One Metacritic user wrote that they “turned it off as soon as saw what was happening.” Other users complained of what they called the show’s “LGBT agenda” or “LGBT propaganda.”

Angry viewers took their complaints elsewhere, too. On Amazon-owned IMDb, the episode still has a decent rating of 8.2 (out of 10). But the second-largest share of ratings — behind a perfect 10 — are a 1.

Some viewers also complained on Twitter.

“As always Hollywood had to push the lgbt agenda on us,” one user tweeted.

“Why can’t they make even one movie or series without the LGBT whatever stuff?” another Twitter user wrote.

Neil Druckmann, the co-creator of the series who also developed the video game, told The Hollywood Reporter that Bill and Frank’s relationship “went over a lot of people’s heads” in the game.

“At the time, [the subtlety is] what helped get it in,” he said. “It’s sad to say, but it would have been controversial otherwise.”

Still, it looks like HBO is getting the last laugh.

The episode was watched by 6.4 million viewers on Sunday, HBO announced on Tuesday, giving it the highest first-night viewership yet for the series. The first two episodes are averaging over 21 million viewers since the show premiered two weeks ago, HBO said, and the network has already renewed the series for a second season.

Plus, critics are loving it: On Rotten Tomatoes, which doesn’t feature user ratings for individual episodes, the episode received a stellar 96% rating from critics.

Rolling Stone‘s Alan Sepinwall called it a “wonderfully powerful, achingly human story.” Victoria Ritvo wrote for Slate: “Although the episode is a masterpiece in its own right, what makes it brilliant as an adaptation is how it plays into the context of the larger show.”

McDonald’s

• McDonald’s reported double-digit sales growth for 2022, driven by a 5% increase in customer count.

When the going gets tough, more people are going to McDonald’s.

The Chicago-based fast food giant reported a 10.9% increase in same-store sales for 2022, powered by a blockbuster fourth-quarter increase of 12.6%.

Like many companies last year, McDonald’s raised prices and widened profit margins, but that didn’t deter customers. In fact, customer count grew by 5% over the year before.

“It is clear the company has a lot of traction,” analyst Neil Saunders, managing director of GlobalData, said in a note.

Saunders pointed to customers increasingly looking for lower-cost dining options, as well as those seeking an inexpensive treat amid rising inflation and economic uncertainty.

Prime examples in 2022 included the McRib farewell tour and McDonald’s collaboration with streetwear brand Cactus Plant Flea Market to produce a limited run of ultra-nostalgic adult Happy Meals in fall 2022.

“Customer excitement was palpable,” CEO Chris Kempczinski told investors on Tuesday, adding that the Cactus program produced the highest weekly digital sales the company has ever seen in the US.

The four-eyed toys and boxes proved so popular that some locations sold out in less than a day.

“We had a line outside our store the first day,” a McDonald’s worker in San Antonio told Insider at the time. “We were sold out [of boxes] by 6 p.m.”

The company plans to step up its pace of new restaurant openings in 2023, spending over $1 billion to open 1,900 stores around the world, Kempczinski said. Of those 1,900, more than 400 new stores are projected in the US and certain other markets such as Canada, UK, and parts of Europe.

On the call, Kempczinski told investors the chain is seeing some signs of a pullback in consumer spending. Customers are buying fewer items, the chain said. Specifically, Kempczinski said that low-income consumers are trading down for cheaper items – but are also coming back more frequently.

Still, Wall Street was impressed by McDonald’s performance, with veteran analyst Mark Kalinowski calling the quarter one of the best year-over-year performances in over a decade at the burger giant.

In a post-earnings note, Kalinowski, who regularly surveys franchisees, said the momentum continues in the new year.

“We believe January 2023 has been very strong for McDonald’s US same-store sales as well — likely up by low double digits,” he said, referring to a metric demonstrating a company’s financial health.

• Billionaire Gautam Adani successfully completed the $2.5 billion share sale of his flagship company on Tuesday, per Bloomberg.
• The stock offering became a crucial confidence test after a short-seller report triggered a massive rout in Adani group stocks.

India’s embattled Adani Group pulled through with the $2.5 billion share sale of its flagship company even after the conglomerate faced a market rout amid fraud allegations by a short seller.

The offering by Adani Enterprises, the country’s largest follow-on share issue, was fully subscribed Tuesday, thanks to some late bids from institutional investors, Bloomberg reported. Demand from retail buyers remained poor, according to the report, following a massive selloff in Adani companies over the past week.

Billionaire Gautam Adani’s business empire came under attack over the past week from Hindenburg Research, which in a report published January 24 accused the conglomerate of  “pulling the largest con in corporate history” — saying the group had engaged in “brazen stock manipulation” and accounting fraud.

That sent the shares of Adani group companies tumbling in the following days, wiping out close to $70 billion in market value. The group dismissed the report as “a malicious combination of selective misinformation and stale, baseless and discredited allegations,” according to a statement by CFO Jugeshinder Singh last week.  

The secondary share sale’s successful completion Tuesday comes after the group had only secured 3% in bids the day before, Reuters reported.

“This looks like high-net-worth people Adani reached out to for support for the [offering] came through,” one Mumbai-based broker told the Financial Times on Tuesday. 

The success of the stock offering will help the company widen its shareholder base and cut its debt. But it’s also a sign that investors have stuck by the Indian conglomerate despite Hindenburg’s allegations.

The share sale was a critical moment for founder Adani, Asia’s richest person who saw his wealth sink by nearly a quarter last week in the aftermath of the short-seller report. But the drop in fortunes is not just for the group’s boss, as other Indian billionaires are also suffering from falling share prices in the companies they have top stakes in. 

The decline in South Asian market sentiment is also reflected in India’s benchmark share index, the Sensex, which is down by almost 3% so far this year.

Memphis prosecutors could bring more criminal charges against police officers and others involved in the events leading up to and following the fatal beating of Tyre Nichols, the county district attorney said in a statement on Twitter on Tuesday.

The tweet came in response to growing criticism over how the Memphis Police Department and the office of Shelby County District Attorney Steve Mulroy have handled the case.

On Monday, the department revealed that a sixth officer, Preston Hemphill, was suspended from the force soon after the Jan. 10 death of Nichols, the 29-year-old Black man, who died in a hospital three days after being pulled over in a traffic stop and beaten. But no charges have been filed against Hemphill, a white officer who was not present at the site of the fatal beating.

Last week five other officers – all of them Black – were charged with second-degree murder and dismissed from the force.

After video footage of the deadly encounter with police was made public on Friday, calls have grown louder for local police officials and prosecutors to be more transparent about the circumstances of incident, given that the initial police reports do not match with what was seen on the videos.

In the statement that first appeared on the district attorney’s website, Mulroy said other policemen, fire department personal and others who prepared documentation of the incident may also face criminal charges as more information becomes available.

“We are looking at all individuals involved in the events leading up to, during, and after the beating of Tyre Nichols,” the office said, adding that the investigation is incomplete.

In an apparent reference to Hemphill, the office said an officer present during the initial encounter with Nichols may also face charges. Hemphill was suspended with pay pending a hearing.

Hemphill, who is white, wore the body-camera that captured the first of four videos released by authorities of the traffic stop and violent confrontation that followed, according to his attorney, Lee Gerald.

In the video, it is Hemphill who appears to fire a stun gun at Nichols after Nichols is dragged from his car, forced to the ground and doused with pepper spray before he breaks free and runs away. The five officers who were later dismissed chased him.

A seventh officer who was not immediately identified was also relieved of duty without pay, the department said on Monday, and that officer has not been charged. His role in the incident has not been disclosed.

Three members of the Memphis Fire Department who responded to the altercation were dismissed on Monday after investigators found Nichols was left handcuffed on the ground without medical attention for nearly 15 minutes after the beating.

Police Chief Cerelyn Davis has said an unspecified number of officers besides the five initially charged remained under investigation for policy infractions stemming from the arrest of Nichols.

The district attorney’s office said that it could comment on the details of the ongoing investigation.

“Our goal remains the same: to seek justice for Tyre Nichols and hold all who contributed to his death accountable. We ask for the public’s patience as the investigation continues,” the prosecutor said.
