The 11th Circuit Court of Appeals just struck down Judge Aileen Cannon’s entire Special Master ruling. This is a huge win for the DOJ, and a huge loss for Donald Trump. This means that the DOJ now immediately gets to work through all of the evidence that it seized from Trump’s home, and gets to make its own decisions about what is or it not privileged ahead of indictment.

Trump can still appeal this ruling to the Supreme Court. But the last time the 11th Circuit overturned Cannon, the Supreme Court immediately said it had no interest in the case. So there is every reason to expect the same thing to happen again, if Trump even bothers to try appealing to the Supreme Court this time. Such an appeal wouldn’t buy him more than about a week, and realistically wouldn’t buy him any time at all, because the DOJ would get to keep moving forward while the Supreme Court spends a week deciding not to take up the case.

The DOJ still has work to do. But it finally has full access to everything it wanted access to. Now it just has to work through it. This Special Master nonsense was the biggest remaining hurdle to indicting Trump, and now it’s gone.

It’s probably worth pointing out that this Special Master nonsense has nothing at all to do with recently appointed Special Counsel Jack Smith. These are two entirely different things that just happen to both have the word “Special” in their name.

In any case, the DOJ and the Special Counsel are now in a position to criminally indict Donald Trump on their timetable, and not the timetable of Trump or any of his stooges. We’re not going to try to predict whether it’ll happen before or after the holidays. But it’s coming soon enough. Today’s landmark ruling is one of the final pieces of the puzzle.

People are starting to say what Palmer Report has been saying for years. Ron DeSantis is overrated. The Floridian Governor did win reelection, and I wasn’t happy about that. But there can be no doubt that the whiny-voiced DeSantis wants to take his act nationally. It won’t work. And some are finally starting to agree.

The Atlantic’s Mark Leibovich has an article out where he cautions against the starry-eyed Republicans putting Ron on a pedestal. “People who haven’t met him think he’s a hot commodity. People who have met him aren’t so sure.”

Here are some other comments made about Desantis:

“Standoffish.”

And my favorite:

“I’d rather have teeth pulled without anesthetic than be on a boat with Ron Desantis.”

That’s telling it like it is. The bottom line is there have been rumors for YEARS about how DeSantis isn’t a people person, and that’s putting it mildly. I’ve been around such people. They may have many good qualities. Being a leader is not one of them.

That’s because leaders have to like dealing with people. And judging by the sound of it, Ron really doesn’t. Like people, that is. He comes off as morose and solitary, lacking virtually any sense of humor. And this article certainly doesn’t put those doubts to bed.

I cannot imagine DeSantis whooping it up in Iowa at the local farm or fair. I cannot see him at a quaint community town hall in New Hampshire. I shudder to imagine him in low-income areas, interacting with minorities or answering the questions of Generation Z. That is because Ron DeSantis just doesn’t have it. You know “it.”

“It” is that elusive quality that many politicians and Presidents have. What DeSantis has is the opposite of “it.” It is virtually impossible to imagine the country embracing DeSantis outside of Florida. But like other candidates before him, Ron just might be the last to find that out.

Congress gave final approval to a bill blocking a national U.S. railroad strike that could have devastated the American economy but rejected a measure that would have provided paid sick days to railroad workers.

The U.S. Senate voted 80 to 15 on Thursday to impose a tentative contract deal reached in September on a dozen unions representing 115,000 workers, who could have gone on strike on Dec. 9.

The bill now goes to President Joe Biden, who will sign it into law. Once the bill becomes law, any strike would be considered illegal and the strikers could be fired.

Eight of 12 unions have ratified the deal. But some labor leaders have criticized Biden, a self-described friend of labor, for asking Congress to impose a contract that workers in four unions have rejected over its lack of paid sick leave.

“We have spared this country a Christmas catastrophe in our grocery stores, in our workplaces, and in our communities,” Biden said in a statement that praised Congress for acting to avoid devastating economic consequence for workers’ families.

A rail strike could have frozen almost 30% of U.S. cargo shipments by weight, stoke already surging inflation, cost the American economy as much as $2 billion a day and stranded millions of rail passengers.

The U.S. House of Representatives approved the bill to block a strike on Wednesday and separately voted to require seven days of paid sick leave for rail workers.

Paid sick leave was one of the outstanding issues in the negotiations. There are no paid short-term sick days under the tentative deal after unions asked for 15 and railroads settled on one personal day.

Teamsters President Sean O’Brien harshly criticized the Senate vote on sick leave. “Rail carriers make record profits. Rail workers get zero paid sick days. Is this OK? Paid sick leave is a basic human right. This system is failing,” O’Brien wrote on Twitter.

The measure to provide seven paid sick days did not win the required 60-vote supermajority in the Senate and was not endorsed by the White House.

A total of 52 senators, including 44 Democrats, two independents and six Republicans voted to mandate sick leave for rail workers, while 42 Republicans and Democratic Senator Joe Manchin voted against it saying he was sympathetic to workers’ concerns but said Congress should not “renegotiate a collective bargaining agreement that has already been negotiated.”

Congress invoked its sweeping powers to block strikes involving transportation – authority it does not have in other labor disputes – because of the significant impact a rail stoppage could have on the U.S. economy, especially at the height of the holiday shopping season.

The Senate earlier on Thursday rejected a proposal by Senator Dan Sullivan to extend the cooling-off period by 60 days to allow for further negotiations.

Biden has praised the proposed contract, which includes a 24% compounded pay increase over five years and five annual $1,000 lump-sum payments, and he had asked Congress to impose the contract without any modifications.

American Association of Railroads CEO Ian Jefferies praised the vote.

“None of the parties achieved everything they advocated for” Jefferies said in a statement and added “without a doubt, there is more to be done to further address our employees’ work-life balance concerns.”

Without the legislation, rail workers could have gone out next week, but the impacts would be felt as soon as this weekend as railroads stopped accepting hazardous materials shipments and commuter railroads began canceling passenger service.

U.S. Chamber of Commerce CEO Suzanne Clark praised “Congress for averting a catastrophic rail strike” and called it “a win for our country.”

Senator Bernie Sanders and others denounced railroad companies for refusing to offer paid sick leave.

“They are maybe the worst case of corporate greed that I have seen,” Sanders said. “That is really barbaric in the year 2022 in America.”

The contracts cover workers at carriers including Union Pacific (UNP.N), Berkshire Hathaway Inc’s (BRKa.N) BNSF, CSX (CSX.O), Norfolk Southern Corp (NSC.N) and Kansas City Southern.

Redigo is a new Go-based malware employed in attacks against Redis servers affected by the CVE-2022-0543 vulnerability.

Researchers from security firm AquaSec discovered a new Go-based malware that is used in a campaign targeting Redis servers. Threat actors are exploiting a critical vulnerability, tracked as CVE-2022-0543, in Redis (Remote Dictionary Server) servers.

Redis (remote dictionary server) is an open source in-memory database and cache.

The CVE-2022-0543 flaw is a Lua sandbox escape flaw that impacts Debian and Debian-derived Linux distributions. The vulnerability, which was rated 10 out of 10 for severity, could be exploited by a remote attacker with the ability to execute arbitrary Lua scripts to possibly escape the Lua sandbox and execute arbitrary code on the underlying machine. Juniper Threat Labs researchers reported that the Muhstik botnet has been observed targeting Redis servers exploiting the CVE-2022-0543 vulnerability.

In March 2022, the U.S. Cybersecurity and Infrastructure Security Agency (CISA) added this flaw to its Known Exploited Vulnerabilities Catalog.

The flaw has been fixed in February 2022, but threat actors continue to exploit it in attacks in the wild due to the public availability of a proof-of-concept exploit code.

The attack chain starts with scans for the Redis server exposing port 6379 to the internet, then threat actors attempt to connect and run the following Redis commands:

1. INFO command – this command allows adversaries to receive information about our Redis server. Among the data they receive, they now know which server’s version is vulnerable to CVE-2022-0543 (As we explained earlier, the honeypot was built with this vulnerability on purpose). This information provides adversaries with the approval they would need to be able to exploit the vulnerability and allow them to start preparing the surface to exploit it.
2. SLAVEOF command – this allows adversaries to create a replica of the attacking server. This action will later help them download the shared object allowing for the exploitation of the vulnerability.
3. REPLCONF command – this command is used in order to configure a connection from the master (the attacking server) to the replica that just was created.
4. PSYNC command – the new replica runs this command and initiates a replication stream from the master. This connection keeps the replica updated and allows the master to send a stream of commands. The attacking server that is defined as the master uses this connection to download the shared library exp_lin.so to the disk of the replica. Furthermore, this connection can use the adversaries as a backdoor, where in case of interrupts during the connection the replica is reconnects and tries to obtain the part of the stream of commands it missed during the disconnection.
5. MODULE LOAD command – this allows for the loading of a module from the dynamic library downloaded at stage 4 at runtime. This library allows for exploitation of the vulnerability and runs arbitrary commands later.
6. SLAVEOF NO ONE command – this turns off the replication and converts the vulnerable Redis server into a master.

Attackers loads the library file exp_lin.so and executes the exploit code for the above flaw. The file contains the implementation of the command system.exec which allows the attackers to execute an arbitrary command and launch the attack.

“The first use of the command is activated to receive information about the CPU architecture. The second use of the command is done to download the newly discovered malware from the attacking server – Redigo. After downloading the malware file, the attackers elevate the permissions of the file to execute, and execute it (for malware investigation read below).” reads the analysis published by AquaSec.

Threat actors simulate Redis communication over port 6379 to evade detection.

AquaSec researchers believe that threat actors are using the Redigo malware to infect Redis and add them to a botnet used to launch denial-of-service (DDoS) attacks, run cryptocurrency miners, or steal data from the servers.

The researchers also provided Indicators of Compromise (IOCs) for this threa.

(JTA) – Bucking weeks of public pressure from Jewish groups, celebrities and the Brooklyn Nets, Amazon will not stop selling an antisemitic documentary on its service that was promoted by NBA star Kyrie Irving.

The company’s CEO Andy Jassy, who is Jewish, said Wednesday that Amazon had no plans to remove or add a disclaimer to “Hebrews to Negroes: Wake Up Black America,” whose Amazon link Irving ignited a firestorm by tweeting about it earlier this month. Amazon had previously considered whether to add a disclaimer.

“As a retailer of content to hundreds of millions of customers with a lot of different viewpoints, we have to allow access to those viewpoints, even if they are objectionable — objectionable and they differ from our particular viewpoints,” Jassy told the audience at the New York Times DealBook Summit.

Jassy drew a distinction between the film, which promotes antisemitic conspiracy theories about the relationship between Jews and Black people, and content that he said “actively incites or promotes violence or teaches people how to do things like pedophilia.” With the latter, he said, decisions to remove content are “more straightforward.”

The e-commerce giant had been internally debating whether to remove the film for weeks, according to reports in Variety. It had been uploaded to the site independently via a program called Prime Direct, which allows user-generated content to be sold on the site’s streaming services.

Irving’s tweet — which shared an Amazon link to the documentary without further comment — came on the heels of more explicitly antisemitic behavior from rapper Kanye West and sparked the ire of the Anti-Defamation League and the Nets, who eventually solicited an apology from the athlete. Nike ended a sponsorship deal with Irving following the tweet. Black Hebrew Israelites, a group whose ideology is promoted in the film, rallied to Irving’s defense.

But critics ranging from ESPN’s Stephen A. Smith to Spotify podcaster Joe Rogan questioned why Amazon was escaping scrutiny for providing the film on its platform.

The ADL has since called on Amazon to do so, and was joined by the American Jewish Committee and a chorus of entertainment figures including Jewish celebrities like Mila Kunis and Mayim Bialik and Jewish studio managers like Haim Saban and Ben Silverman.

According to the Variety report, the ADL’s activism may have been one reason why Amazon declined to take action, as it would be “difficult from an optics perspective,” the outlet wrote, to bow to the demands of a Jewish group amid so many public figures declaring that Jews control the media.

Amazon has in the past removed books promoting pedophilia from its site after news reports, and after the Jan. 6, 2021, attempted insurrection at the U.S. Capitol it removed the white-supremacist novel “The Turner Diaries,” which contains violent antisemitic fantasies and is often used as a hate-group recruiting tool.

After briefly banning Adolf Hitler’s “Mein Kampf” in 2020, the site then reinstated it while adding a disclaimer to the version sold on its site reading, “As a bookseller, we think it is important to offer this infamous work because of its historical significance and educational role in the understanding and prevention of anti-Semitism.” This version of the manifesto also includes an introduction written in the 1990s by the ADL.

Jassy’s position on the film is the latest example of major tech leaders debating their hands-off stances when it comes to moderating antisemitic content on their sites. In 2020, Meta’s Jewish CEO Mark Zuckerberg pledged to remove Holocaust denial from Facebook, reversing an earlier stance that said it wasn’t the company’s place to do so. More recently, newly minted Twitter CEO Elon Musk has taken steps to loosen previous restrictions of antisemitic content on the social media site, including by reinstating Kanye West’s account.

For those repulsed by the antisemitism ramping up on Twitter, Israeli tech entrepreneur Noam Bardin says he’s got a civilized alternative.

Bardin, the former CEO of the popular Waze navigation app, introduced Post News two weeks ago. He’s touting the startup as a platform that won’t tolerate the hateful speech that has blossomed on Twitter in the month since Elon Musk bought it.

Musk has laid off the teams that moderated content and welcomed back rapper Kanye West (who now goes by Ye), former President Donald Trump and others whose accounts had been suspended for inciting violence or spreading bigoted views and falsehoods.

Musk calls himself a “free speech absolutist.” Bardin says the way Musk runs Twitter is “screwed up.”

“There’s this false equation,” he said, that allowing people to be disrespectful “means free speech,” Bardin, 52, said during an interview on the Pivot podcast, hosted by New York Magazine tech journalist Kara Swisher, who is advising him on Post News strategy. “It’s not true, we can all be a little more respectful of each other.”

While Twitter has always operated as a conversational free-for-all, with users chiming in on everything from the day’s top headlines to what they had for lunch, Bardin has oriented his site around news. He told Swisher the site will hopefully generate revenue for the struggling news industry.

Currently, Post News reportedly has a points system that users can use to unlock content that would otherwise be behind a paywall. One user who has gained access to the site wrote earlier this week that she found only one outlet releasing content on the points system — Reuters, the wire service that makes its articles available for free online. 

Bardin indicated he plans to monetize the site by charging for verification, similar to Musk’s much-maligned scheme to sell blue checkmarks for $8 a month. However, Post News’ system would come with a few caveats: Verified users would have to use their real name and would be subject to a stringent moderation policy, which could see punishments for bad actors escalate from restrictions on their ability to share content to an outright ban. 

Post News now has about 67,000 active accounts and 350,000 on its waiting list. By comparison, Musk says Twitter has 250 million daily active users. Mastodon, another social media platform that hopes to benefit from frustration with Twitter, claims 1 million users.

Bardin, a graduate of the Hebrew University of Jerusalem, said Post News will appeal to many who have Twitter accounts but don’t use them.

“I want to stand for the 75% of people that today on Twitter don’t tweet,” Bardin said. “Not the small percentage that make all the noise and have all the followers and make all the excitement. Regular people who want to use social media to get their news and don’t want to be called a Nazi or communist for just having a question.”

Bardin has said he is now hiring engineers content moderators and other staff.

So far he has revealed the identities of two Post News investors: New York University business professor and Pivot co-host Scott Galloway and prominent venture capital firm Andreessen Horowitz (which also invested a $400 million stake into Musk’s acquisition of Twitter).

 How much the site has raised thus far has not been disclosed.
